Chief Justice of Gauhati High Court Madan B. Lokur Friday admitted that though separation of powers in Nagaland has been put in place to some extent, it was necessary to effect full separation of powers among the executive, legislature and the judiciary.
He maintained that the court’s work was to interpret the law as sometimes when the law was interpreted by executive, it may not be in justice. He said this while addressing a gathering at the DC’s conference hall at Phek, on his two-day visit, reported DIPR.
In respect of Nagaland, he said there were to systems – codified laws and traditional/customary laws adding, it was important that both the systems went hand in hand.
Justice Lokur pointed out that customary laws were important and should be encouraged and developed as justice was delivered promptly as they represented were accepted as the collective will of the people. Encouraging people to seek alternative dispute resolution, Justice Lokur said disputes should be settled by people themselves through mediation and good will.
In case of incorrect judgment, he said the aggrieved could appeal to the higher court for justice.
Justice Lokur disclosed that government of India under the 13th finance commission have earmarked Rs.5000 crore, under 5-year plan, for developing of infrastructure and other related judicial works in the states.
He however, lamented that Nagaland government has not submitted or formulated any action plan to avail funds from the Centre.
Justice Lokur also expressed willingness to develop infrastructure in all the customary courts in the North-East and appealed to the law & justice department to prepare and submit an action plan in time for availing funds for infrastructures and other basic facilities like computers and internet connection.
He emphasized on speedy and quality justice and being responsive and just to provide people with what they want at the right time.

K Goswami, Gauhati High Court Kohima Bench, registrar, Gauhati High Court, Kohima bench, LN Sema, joint registrar Gauhati Court, Kohima bench, Chibasao Lotha, joint secretary law & justice, Nanjo, president of high court bar association Nagaland, Timikha Koza, besides several other officials.
