Only President can decide on Gov’s spl. powers: NPCC

NPCC expressed astonishment at the statement made by the state government claiming that Article 371A(1)(b) was made redundant by state assembly resolution in 2013.

NPCC working president Khriedi Theünuo pointed out that Art. 371A has four clauses from (a) to (d) under which (1)(b) provided special responsibility to the state governor on law and order. In this regard, NPCC said since the special responsibility was enshrined in the constitution, only the President of India, if he is satisfied, can direct the state governor to cease such a responsibility. Theünuo said that mere passing of resolution in the assembly on December 17, 2013 to do away with the special responsibility granted to the governor was “unjustified” since there has been no amendment or rectification over Article 371A(1)(b) by the parliament. 

Therefore, he asked the state government to put the record straight and follow procedures if the clause is to be effected.
