Rio however said that the&nbsp; shortage of Rs.712 crore included the already existing shortage of Rs.102 crore on account of salaries even if the 6th RoP was not to be implemented.<\/p>\n<p>Making a statement on the last day of the Twelfth session&nbsp; in reply to the issue raised Friday by Congress MLA K.L.Chishi, Rio informed that all the&nbsp; shortages or enhancement in the deficit Balance from Current Revenue (BCR) of the state were duly taken into account and adjusted by the Planning Commission while working out the size of the State\u2019s Annaul Plan for 2010-11.<\/p>\n<p>He said the process of adjustment of the enhanced deficits in the State\u2019s non-plan expenditure for finalizing the State\u2019s Annual Plan was a normal process and quite different from receiving grant\/money from the Government of India for implementation of the 6th RoP. <\/p>\n<p>He also read out a letter addressed to the leader of the opposition from the union minister of state for finance Namo Narain Meena dated January 2, 2011, which informed that funds were not released to any state for implementation of pay revision for state government employees. He said the matter should be therefore set at rest.&nbsp; <\/p>\n<p>On the accuracy or correctness of the contents of the model reply circulated by the secretary parliamentary affairs, upon which the opposition\u2019s demand for moving a privilege motion was disallowed by the Speaker; the chief minister said that several requests were made <br \/>\nto the central government to come to the State\u2019s assistance for implementation of 6th RoP. <br \/>\nHowever, the chief minister explained the centre\u2019s inability for direct financial assistance for implementation of new pay scales and the advice to the state to take into account the extra deficit in the State\u2019s BCR while finalizing the outlay of the State\u2019s Annual Plan.<br \/>\nHe said the state then took its own decision based on the Centre\u2019s assurance, to&nbsp;&nbsp; implement 6th RoP for the employees. He said the government made the sacrifice in terms of a smaller outlay for the Annual Plan 2010-11.&nbsp; <\/p>\n<p>Rio pointed out that the growth in size of the Annaul Plan 2010-11 was 0% as against&nbsp; 25% during the previous year. He expressed happiness that the growth rate given for the current year(2012-13) was&nbsp;&nbsp; 27.07% over last year. Rio said it clearly showed how the State had&nbsp; made sacrifice in terms of accepting a zero step up in the State\u2019s Annual Plan for 2012-11.&nbsp; <\/p>\n<p>The chief minister pointed out that the matter had been raised on several occasions by the opposition which even sought information from the finance department under RTI. He said that the state government had replied to all these questions in the past and also part of the records of the House.<\/p>\n<p>The leader of the house said that not satisfied with the answers, Congress MLA Lanpha Konyak had asked an unstarred question on the same subject matter during the last budget session in March 2012. Rio said instead of asking the minister-in-charge, which is the only department dealing with receipt of financial assistance from the central government for salary expenses, the Congress MLA chose to put his query on as many as 72 departments.<\/p>\n<p>Ro clarified that since the questions received by the 72 departments were exactly the same, the state government decided to advise all the departments on how to reply.&nbsp; He explained that the circular(by the secretary parliamentary affairs) was neither a final reply nor a directive but only in the form of an advice. <\/p>\n<p>Referring to Congress member&nbsp; K.L.Chishi\u2019s query raised on the nature of circulation of model answer, the chief minister reminded Chishi that he had been a minister for a long time and also a chief minister for a short while and ought to know that the existence of&nbsp; a&nbsp; \u201cRule of Executive Business in Nagaland Government\u201d. He said&nbsp; under the rule, the parliamentary affairs department was responsible for coordinating all matters relating to the State Assembly matters, including advising all departments on how to reply an Assembly questions or how to dispose off any Assembly matters.<\/p>\n<p>Rio said it was up to the minister-in-charge on whether his reply would be exactly as per the model answer or in his own style or language since the model answer was only an advice or assistance to the departments and adding, it was purely an internal matter of the state Government. <\/p>\n<p>Further, Rio informed that the state government receives \u201cmodel Acts\u201d or \u201cmodel Rules\u201d from the Government of India even on subjects in the Concurrent List and the State List. He felt that&nbsp;&nbsp; if the government went in line with the argument advanced by K.L.Chishi, the act of the government of India would amount to breach of privilege of the assembly in Law making as legislation was the exclusive business of the House. <\/p>\n<p>Rio argued, \u201cWhy should one joint secretary or secretary in the Government of India circulate a Model Act or Model Rule?\u201d He said the state had never reacted as it has the right to accept or reject the model act or rule and the right to modify these to suit \u201cour own situational needs. He reminded that such model act or model rules were welcome as&nbsp; their sole purpose was to help in passing better acts and better rules.&nbsp; <\/p>\n<p>Further the&nbsp; chief minister reminded K.L.Chishi of the \u201cprinciple of collective responsibility\u201d of the State Cabinet for which any reply by any minister made the entire cabinet and state government responsible.&nbsp;&nbsp; He therefore felt necessary that any minister or any department can send advisory note to any minister\/department on any Assembly matter that has to be dealt by the State Government.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>State chief minister Neiphiu Rio Saturday clarified on the Rs. 712 crore for RoP as raised by the opposition saying that the figure (Rs.712 crore) was the total projected shortage of non-plan provision for salaries if the 6th RoP was to be implemented.
