{"id":38777,"date":"2017-01-29T23:54:50","date_gmt":"2017-01-29T23:54:50","guid":{"rendered":"http:\/\/151.106.38.4\/2017\/01\/29\/cm-warns-against-disrupting-polls\/"},"modified":"2017-01-29T23:54:50","modified_gmt":"2017-01-29T23:54:50","slug":"cm-warns-against-disrupting-polls","status":"publish","type":"post","link":"https:\/\/nagalandpost.net\/index.php\/2017\/01\/29\/cm-warns-against-disrupting-polls\/","title":{"rendered":"CM warns against disrupting polls"},"content":{"rendered":"<p><img src=\/old_site\/AHYQEIHYGLMMXZNLHPHF.jpg><\/p>\n<div><span style=\"font-size: 10pt;\">Nagaland chief minister T.R.Zeliang has warned apex tribe organisations who have called for state-wide indefinite bandh in protest against the government\u2019s rejection of their appeals to defer civic polls for a dialogue to resolve issues in the Municipal Act and also 33% women reservation, that his government will conduct the polls at any cost and under any circumstances and also warned that security personnel will take action on the spot against those attempting to disturb the polling on February 1,2017.&nbsp;<\/span><\/div>\n<div>&nbsp;The chief minister said while interacting with the press at the CM\u2019s residential office here Sunday where he sought to explain about the government\u2019s legal stand on the municipal act and women reservation.<\/div>\n<div>The chief minister asked the tribe organisations to \u201crethink on their aggressive path\u201d and let rule of law and constitution prevail. He said anyone having grievances against the government can approach the court of law to redress grievances but not through \u201cviolent attitude or action.\u201d<\/div>\n<div>On the withdrawal of candidates after the last date for withdrawal was over (January 17), Zeliang clarified that such declaration made under duress was invalid and which will not be accepted by the State Election Commission(SEC)for municipal polls.<\/div>\n<div>The chief minister said that even if a candidate withdrew after the expiry date, the ballot box will be set up in the polling station and where votes cast will be valid and the candidate who got even one or two votes would be declared elected.&nbsp;<\/div>\n<div>&nbsp;He also said as per the directive of the State Election Commission (on municipal polls), polling officers were expected to complete the election process (till voting) and government was duty bound to protect citizens who go to vote.<\/div>\n<div>The chief minister also narrated the entire issue regarding 33% women reservation, the litigations, amendment, nullifying the 2012 resolution and calling for elections to ULBs in the face of strong opposition from various apex tribe organisations. &nbsp;In all these, Zeliang maintained that the state government stood on the right side of the law and the constitution.&nbsp;<\/div>\n<div>When asked if the state government felt election by going against public sentiment was worthwhile, replied that the state government was not for confrontation and that \u201cbandh or no bandh\u201d elections will go ahead , even if agitations took place even on polling day.<\/div>\n<div>&nbsp;He said Nagaland cannot defer polls since the SEC, set up by the Election Commission of India, has already explained the obligation. In this regard, he said even the prime minister or president cannot interfere in election process once set in. He appealed all sections of people not to take law into their own hands and allow people to exercise their democratic rights as provided by the law of the land.<\/div>\n<div>On the meeting held with JCC, Zeliang said its convenor claimed he was enlightened by the government\u2019s stand and assured he will convince others not to oppose the polls and sought time for extension of the polling date. However, he said it was unfortunate that JCC instead went ahead in calling for the bandh&nbsp;<\/div>\n<div>He said NGO\u2019s or civil societies should not take advantage of government non-confrontation attitude and requested to refrain themselves from creating lawlessness in the society.<\/div>\n<div>Additional advocate general, senior advocate Kakheto Sema explained various articles of the constitution with regard to contentions raised by lawyers over applicability of certain clauses and Article 371A. Kakheto said if the government failed to conduct election then it will tantamount to failure of constitutional machinery and invite consequences of inviting imposition of Article 356.&nbsp;<\/div>\n<div><span style=\"font-size: 10pt;\">Adding to the point, chief minister T.R. Zeliang said only the advocate general can give his legal opinion to the state on controversies or issues regarding and the erroneous interpretation of the Municipal Act pointed, while other advocates can only give their personal opinion.<\/span><\/div>\n<div>On ex-communication of candidates by some tribal bodies, Zeliang said customary system was separate from government, as each village has its own customary practises.<\/div>\n<div>However, Zeliang said he has never heard about customary practises of ex-communication for 30 years. He said the government would take action only if there is legal violation.<\/div>\n<div>Parliamentary Secretary Municipal Affairs R.
