SC to hear case of 3 MLAs Feb 13

Supreme Court has fixed February 13 as the date of hearing on the case of former Nationalist Congress Party (NCP) MLAs- Imtilemba Sangtam, Dr T.M. Lotha and Mmhonlumo Kikon- who had claimed merger with the BJP June 16, 2014.
As per the notification of the Special Leave Petition (Civil) No. 3335/2015, the hearing would be held at the Supreme Court “CAUSELIST for Friday the 13th February 2015, Court No. 7 (of Justice J. Chelameswar and Justice Rohinton Fali Nariman).” The case involves the petitioner (NCP) represented by Er. T.L. Semdok Vs Imtilemba Sangtam and Ors. Advocate Amit Kumar is to represent the petitioner(s) and Advocate Mohinder Jit Singh for the respondents.
Three of the BJP legislators who had claimed merger after causing a split in the NPC legislature, were disqualified by the Speaker on a complaint from the NCP under the Tenth Schedule of the constitution.
The disqualification was set aside by the Kohima Bench and the principal bench of the Gauhati High Court. The NCP then filed a Special Leave Petition (SLP) against the high court judgment with the Supreme Court. In response, the Supreme Court accepted the SLP (C).
