Remission for prisoners

In commemoration of the country’s 64th Republic Day, the state government has remitted the sentences against certain categories of prisoners who have been convicted by the courts (other than court martial) having criminal jurisdiction in Nagaland and sentence to rigorous imprisonment.

According to an official communiqué issued by the home department (home branch), in exercise of the power conferred by sub section I of Section 432 of the Code Criminal Procedure, 1973 (Act Np.2 of 1974 herein after referred as the said Code) the governor of Nagaland has granted remission of sentences to different categories of prisoners lodged in the jails of Nagaland and outside other than those in respect of whom the sentence was inflicted for an offence against the order referred to in sub-section 6 of Section 432 of the said Code passed under any law relating to which the executive powers of the Union extends.

The communiqué further stated that the scale of remission of sentence for different categories were prisoners sentenced to 10 years and above, their scale of remission would be for 30 days, prisoners sentenced to 5 to 10 years (20 days), 1 to 5 years (10 days), one year (5 days).
