SEC.144 CRPC IMPOSED FROM 5 A.M.; BANDH ENFORCERS WARNED
Seen as an attempt to thwart the 12-hour dawn-to-dusk Dimapur bandh called by Nagaland Foot Hill Road Coordination Committee (NFHRCC) on Monday, the state government Sunday, directed the Dimapur district administration to “disallow” the bandh.
In a press communiqué, Dimapur District Magistrate and Deputy Commissioner (DC) N. Hushili Sema, has disallowed the bandh called by the NFHRCC in pursuance of the government order.
The DC has also promulgated 144 CrPC (Code of Criminal Procedure, 1973) (2 of 1974) prohibiting assembly of 5 (five) or more then 5 (five) person from 5 a.m.on June 30.
The DC warned any person/persons or any group of persons found to be violating the order by forcefully imposing the bandh at Dimapur district, shall be seriously dealt with even leading to arrest or detention by any order of the magistrate on duty as authorised under he hand, as per provisions of law.
The DC informed that the order will come into effect from 5 a.m. till 7 p.m. on Monday.
The order was also forwarded to SP Dimapur , sector magistrates/commanders; GBs and chairmen for information and necessary action.
NFHRCC hardens stand; to go ahead with bandh

DIMAPUR, JUN 29 (NPN): Nagaland Foot Hill Coordination Committee (NFHRCC) Sunday hardened its stand and reiterated that it had no other option but to go ahead with the proposed 12-hour bandh (from 6 a.m. to 6 p.m.) on Monday as decided earlier.
NFHRCC convener Supu Jamir said that during the meeting with the Cabinet Sub-Committee (CSC), the PWD (R&B) failed to give any befitting reply to the ultimatum served on the department and the even the CSC failed to intervene on the issue during the course of the meeting on Saturday.
The committee also took exception to the way how principal secretary home & commissioner secretary R&B Temjen Toy challenged the committee stating that the department would not cancel the work order even if the NFHRCC imposed bandh a “hundred times.”
With such as response from the government, Supu Jamir said it has been made “very clear to the general public” that the committee was compelled to go ahead with the bandh on the “advice and direction” of Temjen Toy.
He said that Sunday’s meeting held at the residence of its treasurer with all with the volunteers for the proposed bandh thoroughly discussed about the total bandh and unanimously resolved that under no circumstances, NFHRCC would backtrack from the proposed bandh. The meeting was also attended by lawyers and doctors.
Supu further reiterated that in the event of any untoward incidents during the bandh, NFHRCC would not be held responsible.
With regard to the report that four tribal hohos – Yimchunger, Kyong, Konyak and Phom appealing for calling off the bandh, Supu referred to the joint meeting held between the 10 apex tribal bodies on March 19 this year where resolution no.3 stated that the apex bodies repose faith and confidence on NFHRCC and whatever the committee “acts or does”, the same was to be treated as action of the apex hohos.
PWD (R&B) admitted

NFHRCC also claimed that during the joint meeting called by CSC on Saturday at Hotel Japfu, Kohima, PWD (R&B) admitted its “mistake” of issuing the work order through table tender.
With the last minute preparations ready for Monday’s 12-hour bandh in Dimapur starting 6 a.m. to 6 p.m, Supu Jamir said that PWD (R&B) had fully expressed its views as to why the department had issued Notice Inviting Tender (NIT). NFHRCC had meticulously highlighted the facts and circumstances as to why the committee was praying before the department to cancel the work order issued in view of the fact that the department had already assigned the jeep-able road construction to the committee, said Supu.
He questioned the department asking “was there no rules and regulations when 70% of the jeep-able road was done through table tender.”
Tenyimi Union Dimapur oppose NFHRCC bandh
DIMAPUR, JUN 29 (NPN): Tenyimi Union, Dimapur (TUD) has decided to oppose the proposed Nagaland Foothill Road Coordination Committee (NFHRCC) bandh on Monday.
To make the union’s stand known, TUD also submitted a representation to the Deputy Commissioner (DC) Dimapur on Sunday. In the representation, ten tribe organizations/hohos under TUD – Western Chakhesang Hoho; Chakhro Angami Kuda Union; Mao Hoho; Pochury Hoho; Poumai Hoho; Zeliang Hoho; Inpui Hoho; Rongmei Council; Rengma Hoho and Maram Hoho said
They have been closely observing the recent turn of events with regard to foothill road construction.
The signatories pointed out that the issue was going “awry and towards the wrong directions” with the decision of NFHRCC to go ahead with the 12-hour Dimapur bandh on Monday. Asserting that TUD strongly opposed the proposed bandh, the union asked the district administration to thwart the bandh attempts with an “an iron hand” and assured to render full support.
TUD said bandhs were not only alien to the culture and tradition of the Nagas but it was a crime against humanity.
The union said that looking at the ground realities in Dimapur, it could not just allow “few groups of people” to turn it into a “battlefield or a playground” at the cost of the majority. TUD pointed out that there were other legal means and avenues address the “injustice or grievance.”
The union also reminded that the foothill road was being constructed by the state government and on completion, it would be used by everybody and not just by the 10 tribes repeatedly mentioned by NFHRCC.
TUD said Dimapur and its citizens should not be made to suffer for any issue arising out of foothill road construction.
There could not be any “justification for imposing a bandh” in Dimapur and it was highly objectionable for an NGO to resort to “dictating terms”, especially on the government, said TUD.
The union requested the district administration to ensure that the proposed bandh did not take place in Dimapur and asked the DC to immediately “arrest and put behind the bars” all the leaders who were trying to disturb peace and tranquility in Dimapur by forcibly imposing such bandhs.
TUD urged the government to immediately stop the construction activities of the foothill road until the issues were resolved.
