DC & RO, Phek notifies

In view of the ensuring state general elections and for compliance to the model code of conduct enforced, Nikhashe Sema, deputy commissioner, Phek has notified to all concerned on the following:
Under the Prevention of Defacement of public property Act, 2003- No political party or candidate shall permit his party workers to make use of any individual land, building compound or wall etc., for pasting of notices, pamphlets and putting up of slogans and banners without the owners permission. Temporary and easily detachable materials such as flags/banners may be put up in private places after a photo copy of the permission in written from the owner is submitted within 3 days of putting up the banner to the RO or and officer designated for the purpose.

Permission for use of loud speakers in any manner shall be obtained from the superintendent of police, Phek. Further, use of loud speakers has been prohibited from 10 p.m. to 6 a.m. Public meetings/processions/rallies have been prohibited after 10 pm and before 6 am.

The permission shall be obtained from SP Phek for conducting such meetings/processions/rallies outside the prohibitory hours. Further the candidate cannot hold public meeting and processions during the period of 48 hrs ending with the hour fixed for the conclusion of the poll.

Prohibition of sale of liquor or other intoxicating substance of like nature sale/distribution of liquor and money or any other items used for gratification of voters during election to influence voters shall be treated as bribery and therefore an offence under the IPC and corrupt practice under R.P Act 1951. Both the giver and the receiver will be punishable with imprisonment upto 1year and fine under 171 IPC.

Static surveillance team and flying squads will monitor and keep strict watch for such developments during the election period.

During such checking if unexplained cash exceeding Rs. 50,000 or election materials, drugs, gift packets valued more than 10,000 and which are likely to be used for the inducement of voters are found in the vehicle, the same shall be subject to seizure.

All political parties/candidates has been informed to strictly follow the model code of conduct and also sensitized their party workers and followers, to ensure peaceful and fair conduct of the elections.
