Resolution not meant to clip wings of the Governor: Chief Secy.
Reacting to reports in sections of the local press on the one-day and 3rd session of the 12 Nagaland Legislative Assembly (NLA) on December 17, the state government in a communiqué issued by chief secretary Alemtemshi Jamir clarified that the Rules of Executive Business (REB) has not been amended and neither was the resolution meant to “clip the wings of the Governor”.
The chief secretary maintained that the adoption of the resolution by the house was basically to urge upon the state Governor to “act in accordance with the aid and advice of the council of ministers as mandated by Article 163 of the constitution of India”. Further, he asserted, that amendment to the Rules of Executive Business can only be effected when the Governor “formally approves the decision of the Cabinet as submitted to him.”
Chief secretary further stated, that the second aspect of the resolution was “to endorse the notification No. AR-6/4/78 (Part-I) dated 12th December, 2013 removing certain doubts and clarifying the actual procedure outlined in Rule 34 (2)” notified by the state government as decided by the chief minister under Rule 62 of the REB, which states— “If any doubt arises as to the interpretation of these Rules, it shall be referred to the chief minister whose decision shall be final.”
The communiqué reiterated that the statement was issued so as to avoid confusions in the public mind over the entire matter and also that the resolution adopted was not in any way intended to “undermine the esteemed office of the Governor of Nagaland”.
