After Merangkong Village Council revoked the January 30, 2017 resolution(No.1)of Merangkong Putu Menden and as communicated on March 2,2017, not to allow any candidate(s) to contest from Merangkong village, the Gauhati High Court, Kohima Bench closed the case as it had become infructuous. The Medemsanger Putu Menden had resolved that in view of the sitting MLA being from the village, no other candidate would be allowed to contest the forthcoming election.
The resolution was challenged in the high court as being in violation of the Representation of People’s Act 1951 and fundamental rights as enumerated under Article 19 of the constitution of India. This was reaffirmed in the judgment order.
In his order, the single bench judge, Justice Michael Zothankhuma, after hearing both the counsels for the petitioners and respondents, closed the case since the respondent (No.4) representing the village, informed that the impugned resolution was revoked by the village council.
