The petitioned filed by the NPF president Dr. Shürhozelie Liezietsu against 37 NPF legislators, including the Nagaland Legislative Assembly (NLA) Speaker on the issue of its MLAs defying the NPF party’s chief whip during the July 21 floor test was heard on Thursday.
However, the counsel for the petitioner submitted that he was not pressing on the prayer C and D of the writ petition but his challenge in the petition was confined to the “constitutionality of the decision of the Speaker in accepting or recognizing the whip of respondent no. 2”
The single bench judge, justice S. Serto after hearing the counsel of the respondent, granted three weeks time to file the affidavit-in-opposition of the respondents. In this regard, the court has asked for the matter to be listed on October 12, 2017.
The court also asked the counsel of the respondents to hand over the copies of the affidavit to the other parties so that the matter may be taken up in the admission hearing column.
