
The court of Civil Judge(Senior Division) Dimapur has ordered restraint over the newly installed team of Naga Council Dimapur(NCD) from functioning as executive officers of NCD, till further orders. `
In the October 19,2020 order, the court further stated that the restraint order was issued in the light of “continuous breach of rights” which has manifested as the core issue of the main suit over the action of installation of NCD office bearers while the matter was sub-judice.
The learned judge observed that earlier while the case was still sub-judice, the respondents had it vacated under a questionable manner and published in a section of the media that “the case was settled” in order to mislead the applicants as well as the general public.
Earlier, the court dismissed the plea of the petitioners that the new team was installed when the matter was still in court. The judge said the court vacated the July 19,2020 ad-interim injunction on August 13, 2020 and after which the new NCD team was installed. While not taking up contempt proceedings against the respondents (ex-president NCD and others), the court also took serious note of “misreport and misconception” on the interlocutory application and the main civil suit as published in a section of the press.
