
Gauhati High Court, Kohima bench directed the state government and all to ensure that two candidates, who were allegedly barred from entering their villages and residential premises, be allowed to do so. The court directives also noted that the two should be allowed to contest the election as per the law.
Mayang Lima, native of Chuchuyimlang village, NDPP candidate for 22-Arkalong Assembly Constituency and James Imtikumba Yaden, native of Merangkong village, NDPP candidate for 21-Tuli A/C filed petitions against actions of their village councils, obstructing them from entering their own villages. The petition said that the two had also filed complaints with the Chief Electoral Officer, Nagaland and Deputy Commissioner, Mokokchung.
The court noted that the barring claims have to be investigated by concerned authorities and reminded DC and SP Mokokchung, who the court considered necessary parties to the matter, that it was primarily their duty to maintain law and order.
The court also mentioned Article 21 and with these observations, the court directed the state respondents to ensure that the petitioners were allowed entry into their villages and premises.
