
Draw attention on the confusion on two prohibitory orders issued by the offices of Deputy Commissioner Dimapur and Commissioner of Police Dimapur, the District Public Relations Officer (DPRO) Dimapur has issued clarification to the effect as this could have arisen due to the functioning of Commissionerate system.
DPRO said powers to promulgate prohibitory order under Sec. 144 Cr.PC rested with CP. On the other hand, under Disaster Act, orders pertaining to opening/closure of all shops dealing with essential commodities rested with DC since presently it was not a law and order situation. Had it been a law and order issue then, the CP is empowered to impose Sec. 144 CrPC, it said. In other districts, where there is no commissionerate, one order is issued by DC as the legislative power of Sec. 144 Cr.Pc also rests with the DC.
DPRO said confirmation of the two orders was obtained from both DC and CP, so that public did not view the two orders as authority class/miscommunication between the two offices and also not to be confused as orders were issued in accordance with the law.
